Options to ratify the UN Convention on the Rights of Persons with Disabilities and of its Optional Protocol

The objective of the study is to present to the Government recommendations and practical options for the ratification of the UN Convention on the Rights of Persons with Disabilities and of its Optional Protocol. The study recommends ratification both of the Convention and of the Optional Protocol, mainly because this international document may further facilitate the promotion of the rights of persons with disabilities nationwide.

 The study concludes that the policies on persons with disabilities require a significant change to transform into policies that promote social inclusion and employment, while the current policy has a compensating nature, dominated by a mainly medical approach. This important change is addressed in the draft of a specific strategy on persons with disabilities, developed and proposed by the Ministry of Social Protection, Family and Child (MSPFC). This transformation can provide medium- and long-term sustainable result of manifestation of the disabled.

 An entire set of recommendations relate to improving the institutional framework, strengthening the MSPFC, creating the inter-ministry commission for the coordination of reforms in the field, improving the system of policy development, monitoring and coordinating policy implementation. Under the institutional aspect, it is recommended to establish a framework for preventing discrimination and to authorize a specialized Parliamentary Advocate to closely monitor the rights of persons with disabilities. A number of recommendations relate to changing definitions from the concept of invalidity to that of disability and to introducing the concepts of integration into society and employment.

 Measures for raising the awareness of the public and of decision makers are recommended as priority actions. They are followed by a number of specific recommendations for each article of the Convention. The recommendations include changes of the legislation, creation of services and use of resources existing in the society, and modification of policies and approaches.
