Conclusions: Lack of transparency.
Legal Parliamentary Committee, Appointments and Immunities (Commission) failed to ensure transparency of the decision on the application for membership of the NIC and the NIC chairman of Anatol Donciu. Agenda of the Commission was not announced on the Commission's agenda and any relevant documents were not submitted application for stakeholders discussed. Company could not make the right to a civic control over candidate for State and CNI president. Factions were not consulted as required by law on pnct.7 of CNI. Had violated the Regulation of Parliament, Law on transparency in decision making and the Law on the NIC.
Incompatibility president to occupy the NIC.
Commission in its decision of 25.01.2012 shows no appreciation if the candidate for President of CNI meets the criteria of being owned an extremely public accountability (public dignity, pnct.7 of law on CNI) only finds compliance General eligibility requirements for membership of the NIC (art. 11 of the law on CNI). Prosecutor, senior deputy prosecutor leading CCCEC high-level officials or dignitaries public therefore the appointment of Chairman of the NIC does not comply with the law. Had violated the Law on the NIC.
CNI institutional image problem.
CNI's mission is to ensure transparency regime officials declaring income (including public officials, people with high officials), administrative and public control facility of the company's income statements and conflict of interest. CNI's mission is to serve the interests of the party. Statements of political leaders on the institution's claim as leverage, delayed 6 months NIC functionality, appointed de facto obedience contrary to the law exposes CNI political control. These actions undermine the independence and autonomous functionality of the NIC.
Recommendations:
Anatoly Donciu will resign from the President of NIC because previously held several high positions of public accountability (public dignity) inadmissible for as president of CNI.
Parliament will initiate business legally relevant to restore CNI and will appoint a president who meets all requirements of law NIC.
Civil society representatives will CNI proper attitude toward the situation and multiple violations of law on CNI and decide in such circumstances if the NIC can continue its work.
